The Supreme Court of India is the highest judicial forum and final court of appeal under the Constitution of India, the highest constitutional court, with the power of constitutional review.
Lately, The SC has been declaring revolutionary verdicts in the nation which is kindling a variety of different emotions amongst the public. One such revolutionary verdict was the modification of Section 377 of the Indian Penal Code.
What was Section 377 of the IPC?
Unnatural offences: Whoever voluntarily has carnal intercourse against the order of nature with any man, woman or animal, shall be punished with imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine.
This was such an archaic law which states intercourse between two consenting males or two consenting females as "unnatural", thereby condemning homosexuality as an abnormality.
Fortunately, after the efforts of thousands of people, this law came to be modified and thus, same-sex intercourse became legal. Nobody will understand how much this means to the LGBTQ+ community unless they're one of them.
This verdict has now given the chance for homosexuals to live with dignity, and to love freely anyone they wish to, without the fear of being tagged as criminals.
It is to be anticipated that in the near future, same-sex marriage will also be legalized.
For those who are too naive or lost and are looking for some basic information, here it is.
1. What is homosexuality?
"Homosexuality is the romantic attraction, sexual attraction or sexual behavior between members of the same sex or gender. As a sexual orientation, homosexuality is "an enduring pattern of emotional, romantic, and/or sexual attractions" to people of the same sex." This is the definition stated in Wikipedia.
2. Isn't it abnormal? Isn't it a sin? Gods will send you to hell!
It is COMPLETELY NORMAL. Just how some guys feel attracted to girls, guys can feel attracted to guys too, or girls could feel attracted to other girls too. Even the great epics portray various mythological Gods as non- heterosexual beings.
Many deities in Hinduism and Indian epics are represented as both male and female at different times and in different incarnations or may manifest with characteristics of both genders at once, such as Ardhanarishvara, created by the merging of the god Shiva and his consort Parvati.
There are numerous such examples but since I'm not acquainted with all the religions, I chose the one I'm familiar with.
Also, I don't think humans are out of the world species that popped into the world. They have evolved from the existing creatures which existed in ancient times. I'm saying this to prove that homosexuality in humans is nothing but natural because humans are not the only animals which show homosexual behaviour.
Many other mammals like cats, panda, horses, goats, etc., reptiles like the mourning gecko and the fence lizard, birds like chicken (yes, CHICKEN!), swan, vultures, turkey and many other animals show homosexual behaviour. This just becomes another proof that homosexuality in humans is natural, not a disease or a rare phenomenon.
Side Effects of Homophobia:
1. Creation of an environment which discriminates between HUMANS on the basis of their sexuality.
2. The homosexual person may fall prey to depression, emotional stress and peer pressure to maintain the “heterosexuality”
3. Many people may not be strong enough to deal with these situations and may retreat to self-harm and suicide attempts.
Why do you want to create a world where humans are discriminated, shamed, defamed, harassed and shunned from the society just for falling in love with another human?
The above situation is not only for the sake of the LGBTQ+ community but also other people who have been harassed since they fell in love with a person of the other caste or something like that which the society can’t fathom.
The Honourable Supreme Court can pass as many verdicts it wants to, but in the end, the implementation will only be successful when the people wholeheartedly accept it and choose to abide by the law.
Also for the people who believe in “Ignorance is Bliss” and those who “don’t understand” homosexuality, I’d love to say that there are a LOT of things in this world that you won’t or can’t understand but that doesn’t mean they don’t exist.
To conclude this random rant to enlighten you about homosexuality, I would request you all to create a world where people are judged on the basis of their skill, education and knowledge, not their caste, creed, race or sexuality.
Very true. People should understand that we are HUMANS first.
ReplyDeleteThe things written inthis r all true, but for most of the indian people ... they will take time to accept homosexuallity ... cause some .. not some most of the people wont accept it atleast for noww ... but maybe the upcoming generation will change it
